South Jersey Developer Files Lawsuit Over Delayed Mixed-Use Project

A major mixed-use development in South Jersey is now at the center of a legal dispute. The project’s developer has filed a lawsuit accusing a former employee of interfering with municipal approvals. Additionally, the suit claims efforts were made to redirect the property to Rowan University and a competing firm.

For more than two years, developer Seth Gerszberg and his firm, Active Acquisitions, pursued plans at the intersection of Route 322 and Route 55. The Gloucester County project includes proposals for 10 warehouses, a wholesale retail club, a hotel, and 117 single-family homes. Together, the plans reflect one of the largest development efforts in the region.

In May 2023, an affiliate of Active Acquisitions agreed to purchase the 429-acre property for $23 million. Notably, the site spans roughly 29 times the footprint of Lincoln Financial Field. However, the lawsuit claims the approval process stalled in recent months.

According to the filing, project delays were caused by alleged actions from project manager Sean Earlen. The suit states that Earlen used personal relationships with local officials to undermine confidence in the project. Specifically, concerns were reportedly raised within Harrison Township regarding the development’s feasibility.
